1. Agreement to Terms

By accessing or using PsalmXL.com (the “Site”) and any services, content, features, or applications offered through it (collectively, the “Services”), you agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy.
If you do not accept every provision of these Terms, you must not access or use the Site.

2. Eligibility & Children’s Privacy

  1. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the public portions of the Site and at least 18 years old to create an account or submit content.

  2. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal data, please contact us at info@psalmxl.com so we can delete it.

3. Modifications to Terms or Services

We may change these Terms, our Privacy Policy, or the Services themselves at any time. Changes become effective when we post the revised Terms and update the “Last updated” date. Your continued use after that date constitutes acceptance of the changes.

4. Privacy & Cookies

  1. Our Privacy Policy explains what personal data we collect, how we use it, and your rights.

  2. The Site uses cookies and similar technologies. When you first visit, a banner will ask for your consent to non-essential cookies. You may withdraw consent at any time through our Cookie Settings tool.

5. Intellectual-Property Rights

  1. Unless otherwise noted, PsalmXL LLC owns all content on the Site (“PsalmXL Content”), including text, graphics, logos, and software, which are protected by U.S. and international IP laws.

  2. We grant you a limited, revocable, non-exclusive, non-transferable license to access PsalmXL Content for personal, non-commercial use only.

  3. You may not:

    • copy, reproduce, distribute, or publicly display PsalmXL Content;

    • sell, rent, sublicense, or exploit PsalmXL Content;

    • remove copyright or trademark notices.

  4. Short quotations (≤ 100 words) for commentary or review are permitted if accompanied by clear attribution and a link back to PsalmXL.com.

6. User-Generated Content (“UGC”)

6.1 Posting Rules

When you post comments or other UGC you warrant that:

  • you own or have the necessary rights to post it;

  • it does not infringe any third-party IP, privacy, or publicity right;

  • it is not defamatory, obscene, hateful, harassing, or otherwise unlawful;

  • it is not unsolicited advertising or spam.

6.2 License to PsalmXL

You grant PsalmXL a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to host, reproduce, modify, publish, and distribute your UGC in any media.

6.3 Monitoring & Removal

We may (but are not obliged to) monitor UGC and remove or disable any content or accounts, at our sole discretion and without notice.

7. Copyright (DMCA) Policy

If you believe material on the Site infringes your copyright, send a written notice to our designated agent at info@psalmxl.com (or by mail to the address in Section 17) containing the information required by 17 U.S.C. §512(c)(3). We will respond promptly and, when appropriate, remove the material or disable access.

8. Prohibited Conduct

You agree not to:

  1. use the Site for any unlawful purpose;

  2. attempt to interfere with the Site’s security or proper functioning;

  3. reverse-engineer or attempt to derive the source code of any part of the Site;

  4. harvest or scrape personal data from the Site without consent;

  5. impersonate any person or entity, or misrepresent your affiliation with PsalmXL.

9. Third-Party Links & Integrations

The Site may include links to third-party websites or embed third-party services (e.g., video players). We have no control over, and assume no responsibility for, the content or practices of any third-party sites. Your use of third-party sites is at your own risk.

10. Linking to PsalmXL

You may link to our home page or public articles provided that:

  • the link is not deceptive or misleading;

  • it does not imply PsalmXL sponsorship or endorsement;

  • it appears in a context consistent with your own content.
    We may request removal of any link at any time, and you agree to comply promptly.

11. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, for any breach of these Terms or for any other reason. Upon termination, Sections 5–17 will survive.

12. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PSALMXL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that any content is accurate or complete.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSALMXL (AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SITE OR SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE.
IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) USD 100 OR (B) THE AMOUNT YOU PAID PSALMXL, IF ANY, IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations of liability; in such jurisdictions our liability shall be limited to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless PsalmXL, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of or related to:

  1. your access to or use of the Site or Services;

  2. your violation of any term of these Terms; or

  3. your violation of any third-party right, including intellectual-property or privacy rights.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any lawsuit arising out of these Terms or the Services shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.

16. Arbitration & Class-Action Waiver (Optional)

Any dispute that cannot be resolved informally shall be finally settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU AND PSALMXL AGREE TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.

18. Entire Agreement & Severability

These Terms, together with our Privacy Policy and any additional terms we post for specific features, constitute the entire agreement between you and PsalmXL regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
